Digital Consent & Disclosure

This disclosure and consent form ("Disclosure") is provided to you by the real estate developer, its affiliates, or its agents ("Sender") with whom you are transacting. The Pluto Platform, provided by Pluto Systems Inc. ("Pluto Systems"), facilitates the delivery and execution of electronic documents between you and the Sender.

This Disclosure applies to all communications, documents, notices, and agreements related to your purchase of a property from the Sender (collectively, "Records").

1. Consent to Use Electronic Records and Signatures By checking the box "I have read and agree to the Digital Consent & Disclosure" and clicking the "Agree & Continue" button (or other similar button), you are providing your affirmative consent to conduct business electronically with the Sender. Your consent means that:

  • You agree that your electronic signature is the legal equivalent of your manual (wet ink) signature on the Records.
  • The Sender may provide all Records to you in electronic format through the Pluto Platform rather than in paper format.
  • You have the necessary hardware and software to access, view, and retain the Records electronically. This consent applies to this specific real estate transaction and all related Records. You are not required to consent to conduct business electronically. If you do not consent, please decline the electronic signing process and contact the Sender directly to arrange for the delivery and signing of paper documents.

2. Pluto Systems' Role as a Technology Provider You acknowledge and agree that Pluto Systems provides the software platform that facilitates the execution of Records between you and the Sender. Nothing in this Disclosure or in the provision of services shall be construed to make Pluto Systems a party to any Record processed through its platform. Pluto Systems makes no representation or warranty regarding the transactions sought to be effected by any Record and is not responsible for the content, validity, or enforceability of any Record. The Sender is solely responsible for the content and legality of the Records provided to you.

3. Requesting Paper Copies You have the right to request and receive a paper copy of any Record provided to you electronically. You can download and print any Record from the Pluto Platform during and immediately after the signing process.

If you wish to receive a paper copy from the Sender at a later date, you must contact the Sender directly at the contact information they have provided to you.

4. Withdrawal of Consent You have the right to withdraw your consent to receive electronic Records at any time and at no cost. To withdraw your consent, you must notify the Sender directly.

Please be aware that withdrawing your consent will result in the termination of the electronic signing process for this transaction. All subsequent Records will be provided in paper format. This will slow the speed at which the transaction can be completed, as it will rely on physical mail and manual signatures. Withdrawing consent does not affect the legal validity of any Records you electronically signed prior to your withdrawal.

5. Hardware and Software Requirements To access, view, sign, and retain electronic Records, you must have the following:

  • A computer, tablet, or mobile device with a connection to the Internet.
  • A current version of a web browser such as Google Chrome, Mozilla Firefox, Apple Safari, or Microsoft Edge.
  • A valid, working email address that you can access. We will notify you if there are any material changes to these requirements that will affect your ability to access your electronic Records.

6. Updating Your Contact Information It is your responsibility to maintain a current and valid email address to ensure you receive all electronic Records from the Sender. To update your email address or other contact information, you must use the available Pluto services for this purpose, or contact the Sender directly.

7. Collection, Use and Disclosure of Personal Information By using the Pluto Platform your personal information may be collected, used, and disclosed by the Sender and Pluto Systems in accordance with their respective privacy policies and applicable law. You should review the Sender's and Pluto Systems' privacy policies for more information about how your personal information is handled. 8. Acknowledgment and Confirmation By checking the box "I have read and agree to the Digital Consent & Disclosure" and clicking "Agree & Continue," you confirm that:

  • You have read, understood, and agreed to the terms of this Disclosure.
  • You can access and read this Disclosure.
  • You can print this Disclosure on paper or save it to a location where you can access it for future reference.
  • You consent to use electronic signatures and to receive all Records related to this transaction from the Sender in electronic form.
